1.1 Upon purchase and payment of the applicable license fee, we grant you a limited, non-exclusive, non-transferable license to use the Software on one (1) domain for the duration of your license term.

1.2 License terms are available in 6-month or 12-month durations as selected at the time of purchase.

1.3 This license permits you to:

• Install and use the Software on one WordPress installation
• Receive Software updates during your active license period
• Access technical support as outlined in Section 4

You agree NOT to:

• Redistribute – Share, distribute, sublicense, or resell the Software or any portion thereof
• Transfer – Give, sell, or transfer your license key to any third party
• Modify for Resale – Create derivative works for commercial distribution
• Reverse Engineer – Decompile, disassemble, or reverse engineer the Software
• Remove Notices – Remove or alter any proprietary notices, labels, or marks
• Share License Key – Publish, share, or expose your license key publicly
• Use Nulled Versions – Use cracked, nulled, or pirated versions of the Software
• Multi-site Use – Use a single license on multiple domains or WordPress installations

3.1 You may transfer your license to a different domain (e.g., due to site rebrand or migration).

3.2 Each domain transfer incurs a transfer fee as published on our website at the time of request.

3.3 To request a transfer, contact us through our website contact page with proof of license ownership.

3.4 Upon transfer, the license will be deactivated from the previous domain and activated on the new domain.

4.1 Free Support Period – For the first thirty (30) days following license activation, you are entitled to free technical support including:

• Installation assistance
• Configuration and setup guidance
• Bug fixes and technical issues

4.2 Response Time – During the free support period, we aim to respond within 12 hours during business hours.

4.3 After Free Period – After the initial 30-day period, support is available through:

• Maintenance contract (monthly or quarterly plans)
• Hourly support at published rates
• Knowledge base update and scraping services

4.4 Support does not include customization, third-party plugin conflicts, or server configuration issues.

5.1 Upon license expiration, the Software will cease to function. The chat widget will stop appearing on your website.

5.2 You will receive renewal reminders via email before your license expires.

5.3 Grace Period – A seven (7) day grace period is provided after expiration during which you may renew your license without data loss.

5.4 Data Export – You are responsible for exporting your data (leads, chat history) before license expiration. After the grace period, we are not obligated to retain or provide access to your data.

5.5 To continue using the Software, you must purchase a license renewal.

6.1 You are responsible for maintaining the confidentiality of your license key.

6.2 If your license key is compromised, leaked, or exposed, you may request a free one-time replacement by contacting us with proof of purchase.

6.3 We reserve the right to revoke license keys that are found to be shared, distributed, or used in violation of this Agreement.

7.1 The Software, including all code, design, graphics, documentation, and related materials, is the intellectual property of Smart Build Digital.

7.2 This Agreement does not grant you any ownership rights to the Software. You are granted only the license rights expressly stated herein.

7.3 All trademarks, logos, and service marks displayed in the Software are the property of their respective owners.

10.1 This Agreement is effective until terminated.

10.2 We may terminate this Agreement immediately and without notice if you breach any term of this Agreement.

10.3 Upon termination:

• Your license key will be revoked
• You must cease all use of the Software
• You must delete all copies of the Software from your systems

10.4 Termination does not entitle you to any refund of license fees paid.

11.1 This Agreement shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

11.2 Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.

12.1 We reserve the right to modify this Agreement at any time.

12.2 Changes will be effective upon posting to our website. Your continued use of the Software after changes constitutes acceptance of the modified Agreement.
